Post-Separation
There are some issues such as parenting and support that are reviewable when there has been a “material change in circumstances” from the time the original arrangements were made in a Separation Agreement, Court Order or Arbitral Award. In these circumstances, a party may need to have the terms varied to reflect the current reality.
Common issues that require either annual adjustment or variation post-separation includes: changes to the parenting schedule, parental decision-making, the amount of security required for child support and/or spousal support, adjustment and/or termination of child support and/or spousal support.
