Divorce
While parties can negotiate a separation agreement that addresses legal issues arising from their separation; only a court can grant a divorce. We can assist with handling “uncontested” and “contested” divorces. An uncontested divorce is where parties do not object to a divorce being granted, and will cooperate with the service of court documents. A “contested” divorce can arise when the party who has been served with the divorce application makes counter-claims (e.g., property division, spousal support, parenting time, etc.) or takes issue with the “date of separation”.
We are also able to assist clients in obtaining a divorce in situations where they no longer know the whereabouts of their separated spouse.
In situations where the parties have not addressed their issues in a separation agreement prior to seeking a divorce, or the divorce is contested, we can assist you before the family court.
